Introduction and scope of application

This privacy policy informs you which personal data is processed when you visit and use our website vive-fuerteventura.com - including all associated subpages and subdomains (such as digital accommodation pages). We treat your personal data confidentially and in accordance with the EU General Data Protection Regulation (GDPR) and the Spanish Data Protection Act LOPDGDD (Ley Orgánica 3/2018), which implements the GDPR in Spain. Below we explain what data we collect, for what purposes and on what legal basis this is done, as well as what rights you have in relation to your data.

Hosting at All-Inkl.com and server log files

Our website is hosted by ALL-INKL.COM - Neue Medien Münnich (owner: René Münnich, Hauptstraße 68, 02742 Friedersdorf, Germany). All data generated in the course of using this website is processed on the servers of ALL-INKL.COM. We have concluded an order processing contract with the hosting service provider in accordance with Art. 28 GDPR, which ensures that your data will only be processed in accordance with our instructions and in compliance with the GDPR.

Server log files: When you visit our website, All-Inkl or our web server automatically collects information in so-called server log files. This access data includes, for example

  • Name and URL of the retrieved file

  • Date and time of retrieval

  • Amount of data transferred

  • Message about successful retrieval (HTTP status)

  • Browser type and browser version

  • Operating system used

  • Referrer URL (the previously visited page)

  • IP address and requesting provider

This data is collected on the basis of Art. 6 para. 1 lit. f GDPR. Our legitimate interest arises from the technical security and stability of the operation of the website - in particular for the investigation of misuse or fraud. The log data is stored for a maximum of 7 days and then deleted. Data whose further storage is required for evidence purposes is excluded from deletion until the respective incident has been finally clarified.

Use of cookies and consent banner

Our website uses cookies. These are small text files that your browser stores on your end device. Cookies do not damage your computer and do not contain viruses. They serve to make our website more user-friendly, effective and secure.

Most of the cookies we use are session cookies, which are automatically deleted when you leave the site. Other cookies remain stored on your end device until you delete them and enable us to recognise your browser on your next visit (e.g. to retain the settings you have selected).

You can configure your browser settings so that no cookies are stored, cookies are only permitted in individual cases or cookies are automatically deleted when the browser is closed. Please note that deactivating cookies may limit the functionality of this website.

If cookies are technically necessary for the operation of the website or for certain functions requested by you (e.g. to save your language settings), the data processing is carried out on the basis of Art. 6 para. 1 lit. f GDPR (legitimate interest in the technically error-free and optimised provision of our services). If we use additional cookies (e.g. for analysis purposes), we will ask for your consent in advance (Art. 6 para. 1 lit. a GDPR); details can be found in the relevant sections of this privacy policy.

QR code tracking

We use QR code tracking on our website to analyse the effectiveness of advertising measures with QR codes. Our legitimate interest lies in analysing how often and from where our QR codes are accessed in order to optimise our offering and marketing. It is not our aim to personally identify individual users or to create profiles.

No personal data, such as your IP address, is stored or processed as part of QR code tracking. The data transmitted by your device during the scan is also User agent-string (information about the browser and operating system) is only analysed in a greatly reduced form for data protection reasons - for example, limited to the general browser type (e.g. “Safari” or “Firefox”) and the operating system (e.g. “Android” or “iOS”). If your browser has the “Do Not Track” setting activated, we will respect this: In such a case, we completely refrain from analysing even the abbreviated technical information and only save the date of the respective QR code call.

We do not use any tracking cookies for QR code tracking. The technical access information generated in connection with QR code tracking can also be logged in our server log files (see section “Web hosting and server log files”) - like any other website access - but is also used there exclusively for the technical purposes mentioned.

Multilingualism (TranslatePress)

Our website is multilingual. We use the WordPress plugin TranslatePress to be able to offer content in different languages.

TranslatePress uses cookies to recognise and save the current language version of the visitor. For example, we record which language you have selected and which language version of the site you last visited so that we can automatically show you the appropriate language on your next visit.

These cookies are used exclusively for the functionality and improvement of your user experience (automatic language selection) and not for tracking your user behaviour. TranslatePress does not transmit personal data to the plug-in provider or other third parties. The processing is based on our legitimate interest (Art. 6 para. 1 lit. f GDPR) in a user-friendly, multilingual presentation of our online offer.

Google Maps

We integrate maps from the “Google Maps” service on our website in order to visualise geographical information (e.g. to display our location or places of interest). The provider is Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland). By integrating Google Maps, it may be necessary for information about your use of this website (in particular your IP address) to be transmitted to Google servers and stored there. This may also include transmission to servers of Google LLC in the USA.

The use of Google Maps is in the interest of an appealing presentation of our online offers and an easy findability of the places indicated by us on the website. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR. If consent is required by law (e.g. because cookies are set), we will of course obtain this beforehand (Art. 6 para. 1 lit. a GDPR).

GetYourGuide Partner Programme

We participate in the partner programme of GetYourGuide Deutschland GmbH. In some places on our website, offers, adverts or links from the GetYourGuide travel agency portal are integrated. If you click on such a GetYourGuide link on our site and subsequently make a booking with GetYourGuide, we may receive a commission for this (so-called affiliate system).

GetYourGuide uses cookies to recognise that your booking was made via our website. These cookies enable GetYourGuide to recognise that a user has clicked on a partner link on our website. The storage of “GetYourGuide cookies” is based on Art. 6 para. 1 lit. f GDPR. Our legitimate interest arises from the processing of commission payments: Only with the help of cookies can it be determined whether and in what amount we are entitled to remuneration.

Google Analytics 4

If you have given your consent, we use Google Analytics 4 on our website, a web analytics service provided by Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland). Google Analytics enables us to analyse user behaviour on our website in order to improve our offering. Among other things, page views, interactions, length of visit and technical information (e.g. browser type, operating system, country of origin) are recorded and analysed in pseudonymised form. The IP addresses of users are shortened by default so that no direct personal reference is possible.

The information collected by Google Analytics is usually transferred to servers of Google LLC in the USA. Google is certified under the EU-U.S. Data Privacy Framework, which guarantees an adequate level of data protection. We have also concluded an order processing contract with Google in accordance with Art. 28 GDPR.

Google Analytics is used exclusively on the basis of your consent (Art. 6 para. 1 lit. a GDPR, § 25 para. 1 TTDSG). Consent is obtained via our cookie banner and can be revoked at any time with effect for the future.

Social media presence

We maintain public presences on social networks and platforms (e.g. Facebook, Instagram) in order to communicate with interested parties and customers and to provide information about our services. When visiting our social media profiles, the data protection provisions and terms of use of the respective platform operators apply, over which we have no influence.

If you contact us via social media (e.g. by writing a post on one of our official pages or sending us a message), we will process the data you enter in order to respond to your enquiry. Depending on the nature of your enquiry, this processing is carried out either to fulfil the contract or respond to your enquiry (Art. 6 para. 1 lit. b GDPR) or on the basis of our legitimate interest in effective communication with users (Art. 6 para. 1 lit. f GDPR). We may receive statistical analyses from the social networks about the use of our fan pages, but only in anonymous form, without drawing direct conclusions about individual users.

Please note that you use the respective social networks and their functions on your own responsibility. We have no control over data processing by the social networks. For information on the purpose and scope of data collection and the further processing and use of your data by these providers, as well as your rights and setting options for protecting your privacy, please refer to the data protection notices of the respective social networks.

Data processing on our landing pages

Our landing pages (e.g. digital menus or accommodation pages), which are accessible via QR codes, are provided as separate subpages on our main domain vive-fuerteventura.com. We only process data that is technically necessary to display the content correctly (e.g. IP address, time of access, requested page). This information is stored for a short time in server log files and evaluated exclusively to ensure technical operation and for anonymised access counting. No personalised analysis or profiling takes place.

No cookies are set, no trackers are used and no content from third-party providers (e.g. Google Maps, social media or analysis tools) is loaded. Contact forms or user accounts are also not available on these pages. All texts and translations are stored locally on the server; data is not transferred to external translation services (e.g. DeepL) when you visit the pages.

The processing is carried out in accordance with Art. 6 para. 1 lit. f GDPR on the basis of our legitimate interest in a stable, data-saving and user-friendly website. Your data will not be passed on to third parties.

No use of contact forms, analytics or social media plugins

To protect your data and your privacy, we have deliberately decided not to use certain functions that are frequently found on websites:

  • No contact form and no user accounts: We do not collect any personal data via forms on our website. There is neither a contact or booking form nor the option to register a user account. If you wish to contact us, you can do so voluntarily by email; in this case, we will only use your email address and message to process your enquiry (see section E-mail contact below).

  • No analysis tools or advertising trackers: We do not use external web analysis services such as Google Analytics, Matomo or similar, nor do we use advertising or tracking cookies from third-party providers for marketing purposes. No profiles are created about your usage behaviour. Only the under QR code tracking The internal access counting described above takes place in anonymised form. Your visit to our site is not tracked for advertising purposes.

  • No social media plugins: We have not integrated any Facebook, Instagram, Twitter or other social media plugin buttons into our pages that could transmit data to such networks when the page is loaded. At most, you will find simple links on our site to our profiles on social media platforms (if available), which you can click on. However, these links only establish a connection to the respective provider when you click on them. 

By not using external tracking and social media integrations, we ensure that your data is not unintentionally disclosed to third parties while you are using our website.

E-mail contact

When you contact us (e.g. via contact form, e-mail, telephone or social media), we process your data to process the enquiry and for possible follow-up questions. We process this data - depending on the content of your enquiry - on the basis of Art. 6 para. 1 lit. b GDPR (if your enquiry is related to the initiation or fulfilment of a contract or serves to answer a question you have asked) or on the basis of our legitimate interest pursuant to Art. 6 para. 1 lit. f GDPR (for other enquiries, as we have a legitimate interest in the effective processing of enquiries).

We use the data you provide when contacting us (e.g. name, e-mail address, telephone number and the content of your enquiry) exclusively for correspondence with you and do not pass it on without your consent. We only store this data for as long as is necessary to process your enquiry. If there is no further communication, we will delete your contact details and enquiry content as soon as their storage is no longer required. Statutory retention periods (in particular under commercial and tax law) remain unaffected - i.e. we retain certain communications (such as business correspondence) for the duration of the statutory periods.

Rights of the data subjects

As a data subject affected by data processing, you have various rights under the GDPR and LOPDGDD. You can assert these rights informally at any time using the contact details of the controller provided above. Specifically, you have the following rights:

  • Information: You have the right to obtain information about your personal data processed by us. This includes information about the purposes of processing, the categories of data, the recipients and the planned storage period or the criteria for determining it. We will provide you with a copy of your data on request.

  • Rectification: You have the right to have incorrect or incomplete personal data about you rectified or completed.

  • Erasure: You can request the erasure of your personal data if the legal requirements are met. This is particularly the case if the purpose of the processing no longer applies, if you have withdrawn your consent or if the data has been processed unlawfully. Please note that statutory retention obligations may prevent immediate erasure.

  • Restriction of processing: You have the right to request the restriction of the processing of your data under certain conditions. For example, you can have the processing restricted if you dispute the accuracy of the data (for the duration of the review) or if you have lodged an objection to the processing and it is not yet clear whose interests prevail. In such cases, your data - apart from being stored - will only be processed with your consent or for specific purposes (e.g. to assert legal claims).

  • Objection to processing: If we process your personal data on the basis of legitimate interests (Art. 6 para. 1 lit. f GDPR), you have the right to object to this processing at any time for reasons arising from your particular situation. If you object, we will no longer process your data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms. You can object to processing for direct marketing purposes at any time without giving reasons; in this case, we will no longer use the data concerned for direct marketing purposes.

  • Data portability: You have the right to request data that we process automatically on the basis of your consent or to fulfil a contract in a commonly used, machine-readable format. At your request, we can also transfer this data directly to another controller if technically feasible.

Revocation of consent: Many data processing operations are only permitted with your express consent. You have the right to withdraw your consent at any time. All you need to do is send us an informal message (e.g. by e-mail). The revocation does not affect the legality of the data processing up to the revocation - i.e. the processing carried out up to that point remains legitimate.

Right to lodge a complaint with the supervisory authority: If you are of the opinion that we are violating data protection regulations when processing your data, you have the right to lodge a complaint with a data protection supervisory authority. To do so, you can contact the supervisory authority in the EU member state of your place of residence, your place of work or the place of the alleged infringement. For Spain, the competent authority is the Agencia Española de Protección de Datos (AEPD), which you can reach at www.aepd.es. The right of appeal applies without prejudice to other administrative or judicial remedies.
